1. General

By placing an order with Skistore Swing, you indicate that you agree with the delivery and payment conditions of Skistore Swing. Skistore Swing has the right to change its delivery and / or payment conditions. If you receive items that you have not ordered, you must inform Skistore Swing as soon as possible. Any inaccuracies in the data provided to you by Skistore Swing must be reported immediately by you to Skistore Swing, as well as any changes or inaccuracies in your data that you have provided to Skistore Swing.

2. Applicability

  • These General Terms and Conditions of Sale (hereinafter: Conditions) apply to all offers, orders and agreements of Skistore Swing, to the exclusion of any other General Terms and Conditions.
  • General Terms and Conditions used by the buyer do not apply unless explicitly agreed in writing by Skistore Swing.
  • By using the website of Skistore Swing and / or accepting an offer or placing an order, you accept the applicability of these Conditions.
  • The provisions of these Conditions can only be deviated from in writing, in which case the other provisions remain in full force.
  • All rights and claims, as stipulated in these Conditions and in any further agreements for the benefit of Skistore Swing, are also stipulated for the benefit of intermediaries and other third parties engaged by Skistore Swing.
  • Skistore Swing reserves the right to change and / or supplement the General Terms and Conditions from time to time.

3. Agreements

  • An agreement is only concluded after acceptance of your order by Skistore Swing. Skistore Swing is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Skistore Swing will notify this within ten (10) working days after receipt of the order.
  • Offers are valid while stocks last.
  • Information, images, oral communications, statements, etc. with regard to all offers and most important features of the products that are provided by telephone, via the website or via e-mail are displayed or made as accurately as possible. However, Skistore Swing does not guarantee that all offers, color fastness of product photos and products are fully in accordance with the information provided. In principle, deviations cannot give rise to compensation and / or dissolution.

4. Prices / Offers

  • All prices are expressed in Euros, in accordance with the legal regulations in this regard and include sales tax.
  • SkistoreSwing.nl will state the shipping costs to the buyer at the latest at the conclusion of the agreement.
  • All offers from Skistore Swing are without obligation and Skistore Swing expressly reserves the right to change prices, especially when this is necessary on the basis of (legal) regulations.
  • Special offers are only valid while stocks last.
  • Skistore Swing accepts no liability for the consequences of printing errors and changes in price indications. If a stated price is so incorrect that the customer can reasonably know that it is an error, Skistore Swing has the right to refuse the order.

5. Legal right of withdrawal

You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you or a third party designated by you, who is not the carrier, takes physical possession of the good.

You can use the enclosed model withdrawal form for this, but you are not obliged to do so. To meet the withdrawal period, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the revocation

If you cancel the agreement, you will receive all payments that you have made up to that moment, including delivery costs (with the exception of any additional costs resulting from your choice of a different method of delivery than the cheapest standard delivery offered by us) without delay and in any case no later than 14 days after we have been informed of your decision to withdraw from the contract. We will pay you back with the same payment method with which you made the original transaction, unless you have explicitly agreed otherwise; in any case, you will not be charged for such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have demonstrated that you have returned the goods, whichever comes first.

You must return or hand over the goods to us without delay, but in any case no later than 14 days after the day on which you have notified us of your decision to withdraw from the contract. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods.

You are only liable for the depreciation of the goods resulting from the use of the goods, which goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Excluded from the right of withdrawal is a consumer purchase that relates to the delivery of:
- products manufactured according to the consumer's specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision of the consumer, or that are clearly intended for a specific person;
- products that spoil quickly or that have a limited shelf life;
- products that are not suitable for return for reasons of health protection or hygiene and which have been sealed after delivery has been broken;
- products that by their nature have been irrevocably mixed with other goods after delivery;
- audio and video recordings and computer software of which the seal has been broken after delivery;
- newspapers, magazines or magazines , with the exception of an agreement for the regular supply of such publications (a subscription);

6. Exchange

You have the right to exchange the product within 14 days after delivery including the invoice, provided it meets the following:

  • The items must be returned complete including labels, stickers and other items that are included.
  • Some items can only be exchanged if the packaging is unopened. Think of DVDs, sealed packaging, wax, etc.
  • The costs of postage for the return shipment are for your own account.
  • At the end of this period, the sale is finalized and you remain the owner of the purchased.
  • We also offer you the option to exchange your product at our store. Exchange is only possible if you can hand over the original proof of purchase, as included in the shipment, to our store employees. Unfortunately, our store employees cannot take the product back without the original proof of purchase. The conditions as described in article 5 apply to returns. Any (travel) costs incurred for returning in our store are at all times for your own account.

RETOURVIGNET®

The received item is sealed with a Return Vignette® seal and hangtag. Trying on and assessing may be done, but do not wear and/or use. Trying on in a hygienic way is allowed but make sure that when trying on the articles are not damaged and/or soiled. Product labels and tags may only be removed if this prevents fitting and assessing the article. The return vignette is attached in such a way that fitting must be possible. Removing the Return Vignette® seal nullifies the right to return and refund. If you wish to return the item, please ensure that you return the item to us in its original condition and factory packaging. Please make sure that all product labels are enclosed and the Return Label® has not been removed. This is the only way we can make returns sustainable together and make someone else happy with this 'new' item. We hope for your cooperation! The right to return and refund expires when:

  • The product is soiled and/or damaged\
  • The product has been washed
  • The Retourvignet® seal has been broken

7. Delivery

  • The delivery times stated by Skistore Swing are only indicative. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or to dissolve the agreement, unless the delivery period is exceeded to such an extent that you cannot reasonably be expected to maintain the agreement. In that case you are entitled to cancel the order or to dissolve the agreement insofar as necessary.
  • The delivery of the products takes place at the place and time when the products are ready for shipment to you.
  • The Buyer is obliged to carefully inspect the products immediately upon receipt.
  • Delivery time depends on the items you have chosen.
  • It is possible that Skistore Swing cannot deliver a certain article immediately. We will inform you by e-mail as soon as possible. Therefore, make sure that you provide a correct e-mail address when creating your order and check it regularly. Skistore Swing will keep your order. If subsequent delivery is ultimately no longer possible, you will also be notified and your order will be canceled.
  • If you have paid an amount in advance and if the agreement to which that advance payment relates is not concluded because the originally ordered goods are not available or are canceled on the basis of the right of withdrawal, a refund will be made as soon as possible, but no later than fourteen days.
  • All reported or stated delivery times are only an indication and do not lead to any right or liability. Skistore Swing is not responsible for possible loss, damage, costs resulting from any late delivery.
  • Pick up in our store branch. Have you seen a product on our site and still find it easier to visit one of our stores? Then you can contact the store of your choice by telephone to check whether they have the relevant product in stock. You can reserve this product for a maximum of 5 days (non-sale items). This way you can try on the products first and see them in real life before making a purchase. You can also use the advice of our specialized sales staff.
  • The order will be delivered to you by Skistore Swing in collaboration with PostNL or TNT. Skistore Swing does not ship orders to PO Box addresses.

8. Retention of title

  • The ownership of the delivered products is only transferred if you have paid all that you owe to Skistore Swing under any agreement. The risk with regard to the products is already transferred to you at the time of delivery.

9. Electronic communication and evidence

  • Skistore Swing is not liable for misunderstandings, mutilations, delays or incorrect transmission of data and messages as a result of the use of the Internet or any other means of communication in the traffic between the Customer and Skistore Swing (or third parties engaged by the Customer). , unless and insofar as there is intent or gross negligence on the part of Skistore Swing.
  • The administration of Skistore Swing applies as full proof of the existence, content and implementation of the agreement with the Customer in any legal proceedings, until proof to the contrary by the party, who relies on the fact that the evidence is not reliable.

10. Force majeure

  • Without prejudice to its other rights, Skistore Swing has the right, in case of force majeure, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, in writing. and without Skistore Swing being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to the standards of reasonableness and fairness.
  • Force majeure is understood to mean any shortcoming that cannot be attributed to Skistore Swing, because it is not attributable to its fault and cannot be attributed to it by law, legal act or generally accepted beliefs.
  • Force majeure is understood to mean any circumstance beyond its control which prevents the fulfillment of its obligations towards the Buyer in whole or in part. These circumstances include strikes, fire, business disruptions, power disruptions, disruptions in a (telecommunication) network or connection or communication systems used and / or the unavailability of the internet site at any time, non-delivery or late delivery from suppliers or other engaged third parties and the lack of any government permits.

11. Warranty

  • For products delivered by Skistore Swing only the warranty applies, as determined by the manufacturer of the product concerned. Skistore Swing only fulfills a counter function during such a guarantee period. To be clear: warranty is provided by the manufacturer or importer and almost never by the store where you buy the item. Incidentally, we are responsible for the correct functioning of the article. In this way, we will at all times ensure that the relevant service organization performs its work correctly.
  • Skistore Swing is never obliged to pay any compensation to the Buyer or others, unless there is intent or gross negligence on its part.
  • If Skistore Swing for whatever reason is obliged to compensate any damage, that compensation will never exceed an amount equal to the invoice value with regard to the product or service that caused the damage.
  • Without prejudice to the provisions of this article, there can be no warranty if the wear can be regarded as normal and further in the following cases:
    • if changes have been made in or to the product, including repairs that have not been carried out with the permission of Skistore Swing or the manufacturer;
    • if the original invoice cannot be submitted, has been changed or made illegible;
    • if defects are the result of improper use or improper use;
    • if damage is caused by intent, gross negligence or negligent maintenance.
  • Repair or replacement does not entail renewal and / or extension of the warranty period.
  • Incorrect warranty claims. If, after inspection by the manufacturer, the product shows no defects or the defect is caused by its own defect, the investigation costs and the shipping costs will be charged to the customer.
  • The Buyer is obliged to indemnify Skistore Swing against any claim that third parties could assert against Skistore Swing with regard to the execution of the agreement, insofar as the law does not prevent the relevant damage and costs from being borne by the Buyer must come.
  • It is possible that Skistore Swing includes links on its internet site to other internet sites that may be interesting or informative for the visitor. Such links are purely informative. Skistore Swing is not responsible for the content of the internet site to which reference is made or the use that can be made thereof.

12. Personal data

  • Skistore Swing will only process the data of the Buyer in accordance with its privacy policy. 2. Skistore Swing will observe the applicable laws and regulations.

13. Applicable law and competent court

  • All offers and agreements are exclusively governed by Dutch law.
  • All disputes related to or arising from offers from Skistore Swing or agreements concluded with it will be submitted to a competent court.

14. Online Dispute Resolution
